Artículo Tercero Constitucional: Génesis, transformación y axiología

La Constitución mexicana contiene un proyecto de Estado de derecho; ahí, la edu-
cación se ha definido como necesidad social y derecho fundamental. Este trabajo

muestra los antecedentes del artículo 3° Constitucional de 1917 y su transformación,
ubicándolo en las transiciones de México. Primero, se hace un análisis de los textos
constitucionales previos a 1917 para identificar cómo se prescribe la educación. Luego
se describe el artículo 3° de 1917 y sus reformas así como una visión de su estructura
valoral. A continuación, se expone el desarrollo de la legislación secundaria sobre este
artículo y se presenta un esquema de la axiología del artículo 7o de la Ley General
de Educación. Se concluye que como producto del constitucionalismo mexicano,
el artículo 3o y la legislación que lo regula crean una perspectiva moral para la
formación del ciudadano.
Abstract:
The Mexican Constitution contains a blueprint for the rule of law, where education
has been defined as a social need and a fundamental right. The current study shows
the precedents of Article Three of the Constitution of 1917 and its transformation,
positioning the article in the transitions of Mexico. First, an analysis is made of the
constitutional texts prior to 1917 to identify the definition of education. Then a
description is provided of Article Three of 1917 and its reforms, as a vision of the
structure of value. The development of secondary legislation involving the article is

explained, and the axiology of Article Seven of the General Law of Education is pre-
sented. The conclusion is that as a product of Mexican constitutionalism, Article Three

and the legislation that regulates it create a moral perspective for citizen education.
